Question: Are out-of-state agencies allowed to participate?

Question: Would our agency be required to register with the state of Alabama before we acquire a contract?
Answer: Yes. Sections 10A-1-7.01 and 10A-1-7.21(a), Code of Alabama (1975), respectively, provide that, with a few specific exceptions, all non-Alabama entities (called “foreign entities” in the Alabama Business Entity Code, and hereinafter also referred to as “foreign entities”) must register to do business in Alabama prior to transacting business in this state and maintain their registration while transacting business here, and that foreign entities are barred from maintaining actions in Alabama courts until they have registered to do business in this state. Further, Section 10A-2-15.02(a), Code of Alabama (1975), provides that all contracts entered into by foreign corporations prior to registering to do business in this state are void and cannot be enforced by the foreign entity.
Question: To be considered would our agency be required to have an office in Alabama?
Answer: No. However, Section 10A-1-5.31, Code of Alabama (1975), requires all foreign entities to have a registered agent and a registered office in this state. The registered office does not have to be a physical place of business for the foreign entity, though.
Question: Our agency is headquartered in another state. If we setup a satellite office in Alabama, would this suffice the need to be a business registered in Alabama stipulation?
Answer: No. Even if a foreign entity sets up a satellite office in Alabama, it must still register to do business in this state before it transacts any business here, as discussed in further detail in No. 3 above.
Question: What is the process and website to register with the State of Alabama?
?Answer: The general procedure for registering a foreign entity to do business in Alabama is found in Section 10A-1-7.04, Code of Alabama (1975). The Alabama Secretary of State has prepared forms for foreign entities to use to register to do business in Alabama. These forms, which vary depending on the type of business entity involved (i.e., corporation, L.L.C., etc.), as well as other information concerning the registration requirements and procedures, can be found on the Business Entities page of the Alabama Secretary of State’s website (http://www.sos.alabama.gov/BusinessServices/BusinessEntities.aspx).
Question: Does the System have a current relationship with an advertising agency in the state?Answer: The System does not have a current relationship with an advertising agency.
Question: Will an in-state agency be preferred? How much weight does an in state company have on your decision?
Answer: In-state agencies will not be weighted differently. See Section 6.2 – Evaluation Criteria. The lowest responsible bidder selected for an award will be the Respondent whose proposal is the most advantageous to the System.
Question: Can you clarify the association with Calhoun Community College? Is the proposal for the entire system, contracted through Calhoun?
Answer: Calhoun Community College is the project manager for this RFP on behalf of the Alabama Community College System Marketing and Branding Committee. The intent of this Request for Proposal (RFP) is for the Committee, through Calhoun Community College, to identify and contract with a qualified full service marketing and advertising company to develop an integrated strategic marketing plan and branding campaign which will broaden public awareness of the System.
Question: Who will the agency ultimately work for? Does work flow through a committee of representatives from each college or is there a defined process with one assigned main System representative?
Answer: The selected agency will be contracted through Calhoun Community College, on behalf of the ACCS Marketing and Branding Committee. At this time, the work flow process has not been determined, and will be based on the contracted scope of work as determined by the committee and budget constraints. There will be a point of contact with whom the selected agency will work.
Question: What is the decision-making process?
Answer: The Committee will review all proposals and make a selection based on the one that is most advantageous to the system (See Section VI. 6.1-6.2 Evaluation Process). The Committee, at its discretion, may select one or more finalists. Finalists may be given the opportunity to provide a presentation regarding their proposal. Any travel related to these interviews will be the responsibility of the Respondent. Calhoun Community College, on behalf of the Committee, reserves the right to accept or reject any or all proposals in response to this RFP, or to discontinue a desire to acquire a solution, without recourse by the respondent(s).
Question: Is there a points system associated with the scoring?
Answer: See Section VI. - Evaluation Process. All elements of the RFP should be addressed. The lowest responsible bidder selected for an award will be the Respondent whose proposal is the most advantageous to the System.
Question: Is research, strategic marketing planning, brand (visual identity system), and marketing recommendations all that is included in Phase 1: Advocacy Campaign? If “no”, what else is included?
Answer: All elements of the RFP for each phase should be addressed. See Section III – Scope of Project.
Question: Will the ACCS consider awarding the bid for Market Research & Analysis, Strategic Marketing Plan, Branding Campaign, Branding Identity System, Visual Identity System separately from Media Planning and Buying? In other words, if a firm conducted the research and developed the brand platform and developed the creative templates for the system and the colleges to implement, would the system hire an Alabama media placement firm for the media buying and placement.
Answer: The intent of the Request for Proposal (RFP) is to identify and contract with a qualified full service marketing and advertising company; however, partnerships with other marketing/research/advertising entities may be allowed. Costs incurred by any other partner agency would be the responsibility of the contracted agency. Any partnering agency must also meet the requirements of the RFP. Based upon budget priorities, “there may be opportunities for the awarded company to provide creative services, media planning and buying, as well as web platform functions and strategies.”
Question: Are partnerships with other marketing/research entities allowed?
Answer: The intent of the Request for Proposal (RFP) is to identify and contract with a qualified full service marketing and advertising company; however, partnerships with other marketing/research/advertising entities may be allowed. Costs incurred by any other partner agency would be the responsibility of the contracted agency. Any partnering agency must also meet the requirements of the RFP.
Question: Are there preferred times of the year for implementing paid media?
Answer: This has not been determined.
Question: Is there an allocated budget amount or budget range for the projects specifically described in the RFP?
Answer: This has not been determined.
Question: What is the desired timeline for each phase?
Answer: We expect the contracted agency to provide suggested timelines in the proposal. See Sections 5.1 and 7.1 for additional information. Projected timelines below provide a tentative framework to build upon:
Advocacy Campaign: Projected implementation of the Advocacy Campaign is January, 2013 with heavy focus during the legislative budget process which occurs February through May; however, suggested timelines should also include recommendations for continuous advocacy support.
ACCS Website Redesign: Projected implementation of the redesigned ACCS website should complement the implementation of the Advocacy Campaign (no later than March, 2013).
50th Anniversary Campaign: We anticipate the 50th Anniversary Campaign to be a year-long opportunity during 2013 to complement the ongoing advocacy campaign. Events should include 1) ACCS Legislative Leadership Day event (March, 2013); and 2) recognition of National Community College Month (April, 2013). See Section 3.1 for a description of the April 2012 combined event highlighting ACCS Legislative Leadership Day in recognition of National Community College Month. It is anticipated that design elements of the 2013 Annual Report (to be completed in December 2013) would complement and/or include those elements developed for the advocacy campaign and 50th Anniversary celebration.
Question: What is the preferred platform for the website? HTML, Wordpress, other?
Answer: Our Content Management System is DotNetNuke (Community Edition) using a Microsoft SQL database. We have some basic HTML legacy pages, too, which we will upgrade ourselves soon.
Question: Is a CMS needed for the website?
?Answer: No new CMS is needed; our current CMS meets our needs.
